1. All photos are copyrighted photos, and are registered with the Federal Copyright office. Library of Congress. Kent Kerschner Photography aka Foto Cowboy All images REGISTERED in accordance with Title 17 United States Code, with U.S. Copyright office, Library of Congress. © 2016 Kent Kerschner Photography aka Foto Cowboy. My Name and or Logo must remain ON the photo to be used. Not listed in extremely small fine print. IT WILL BE ON THE PHOTO or it can not be used. Its my right. NOT yours to tell me to send a photo with out my logo and or name.

2. Copying of images by any means, devices or in any manner, without the expressed written permission of the Copyright owner, is prohibited by Federal Law (Title 17 United States Code) and will be prosecuted in accordance with Title 17 United States Code. YOU cannot copy any photo in any manner . Just because you purchased a photo does not give you the freedom to copy in any manner that is known at this time or in the future. You must get a letter in writing, stating you can. This includes you cannot take a photo or copy it to put on any social media. This is a violation of the copyright laws.

3. Any request(s) for image(s) for publication must be made in writing, sent to: fotocowboy@sbcglobal.net. Per our Terms and Conditions of Usage, payment is due prior to release of image(s) for publication. All requests pertaining to “Photo Credit” for payment will be rejected. Copyright(s) of all images will remain the exclusive property of Kent Kerschner aka Foto Cowboy and not be transferred. All requests for transfer of copyright(s) will be rejected. All image(s) must be accompanied with ©20xx Kent Kerschner aka Foto Cowboy All Rights Reserved. All magazines wanting a picture for publication will have to purchase the photo for publication. Payment must be received BEFORE any photo is sent. The photo will be released with a photo print release, stating you can use it for the one time use, and NO other use is granted or implied! Once payment is received. *** I hold all copyrights to all my photos, and are Registered with the Federal Copyright office, with the Library of Congress.**** NO photo is given just for "Photo Credits" My bank does not accept photo credits for payment. I accept all major credit cards, and I can send you a Square invoice for payment. UNLESS prior arrangements are made. This is my terms of use.

4. Images licensed for use are only allowed for specific usages granted under the terms of the sale. Example: Images licensed for Facebook cannot be used anywhere other than Facebook. Usage of a licensed image(s) in an unspecified manner is a violation of Title 17 United States Code. All licensed usages will be enforced. Example: a Facebook only image on an advertisement or website selling your horse is a copyright violation and is not permitted. Facebook images are for just as it states.. Facebook use only. They will have the special Facebook logo on the photo. Which you do not have permission to remove or alter or remove my logo in any manor. They CANNOT be used for any type of "for Sale sites". Just like it says, its for FACEBOOK ONLY

5. All photos are considered Special order items. All sales on any and all photographic/video items are final.

FAQ's
Q-When will I see them on Facebook, so I can see and tag my photos.
A- Sorry, as a professional photographer, I dont plaster all my photos on Facebook. If you want to see your photo on Facebook, I offer those for sale. I will post a link on Facebook for you to see the photos. I I may also post a "teaser" photo on Facebook, but putting My copyrighted photos on Facebook is not a going to happen..

Q- I see your a cowboy, so that means you only do Rodeos.
A- NO, I am a cowboy yes and dress like a cowboy. That's my trade mark, my branding. I do all types of photography. Weddings, Sports , Portraits, Commercial. If I can't do a shoot, I have a list of Trusted photographers, If i can't do the session.

Q- Do i get a CD with a copyright release with my pictures.
A- NO! I'm a traditional photographer. Are you not looking for a Professional Photographer. Why pay for a Professional service just so you can take them to a place like Walmart-Walgreens, to have them print them off to make them look bad, and MAKE me look bad. I take pride in providing Professional Quality photos. It is like an insult having the photos printed at substandard labs. Those labs use inkjet printers to make the prints that will fade and look bad. Yes, I do offer Digital files. But for a Price! But its not a standard practice to just hand over a CD or my rights. I worked hard to get those photos. Does an author of a book hand over the rights to a book they wrote? Do you ask the person that is baking the cake to just hand over the ingredients, and you bake the cake? Then it don't taste like what you expected. I own all rights and Copyrights to my work. I do offer and sell Print releases for some things. I am NOT a shoot and burn photographer, or a sideline. I have over 38 years of photography experience.

Q- I bought the photos, so I can copy them and make my own reprints from the photos I purchased.
A- NO. All photos are copyrighted. Making copies in any manor is illegal. Is the same as making counterfit money. I want to make sure the reprints are of the same professional quality. (Only if you purchased a print release, with a limited use) I still own the rights.

Q- When will I be able to see proofs of the shoot.
A- Usuaully I have the proofs on my online gallory with in 24 hours of the event. Since I know how to tell the camera what I want. I don't have to sit behind the computer for HOURS over editing photos.

Q- Do you use professional photo labs and equipment.
A- YES!!! All of my ordered online photos are printed at Professional Labs. NO one hour, or box store labs. Thats why i'm a professional. I use professional equipment. Using a substanard lens, you will get substandard quality. You can't get the sharpness, the clarity of the image. All Equipment is professional.

Q- How long does it take to get the prints when I order them.
A- If you order them on lets say a Monday before noon, they are usually shipped with in 1-2 Business days..( Holidays, Weekends and if i'm out of town for a huge event, this will delay the orders by a week. I do post a message if i'm out of town for a week or more.

Q- Do you Photo shop your images.
A- Not as a normal process. I am a traditional photographer. I learned to take the shot to GET the shot. We didn't have photo shop back then. We had to tell the Camera what to do. I dont put the camera on "auto". The only photo shopping I do may be for things like, pimples, scratches, ect. If you wear wrinkled clothing. I wont spend the time to fix that, I dont put funky looking sky's or distracting sun lens flairs in the photo. Digital Art work is available for a fee, but that is not considered photography. That is Digital art.

Q-Do you charge for extra people in portrait sessions.
A-NO. But they have to purchase their own images.

Q- Do you have a studio.
A- No, not at this time. Having a studio is an added cost. I like to use the world as my studio. I come to you. Or I can find a place to take the photos.

Q- So do you only shoot local.
A- NO.. I travel the world. Travel is not a problem. But I will have to charge for travel out side of Hutchinson, KS.

Q- Can I get my pictures taken on train tracks
A- NO!! I will get a ticket, and you will get a Ticket.. I want all sessions to be safe. If you want that type of photo, you have to get it in writing, and they the track owners have to be present while the shoot is taking place.

Q- If I misplace or delete my photos or loose the, or deleted my social media account, digital files, will you replace them for free?
A- NO.. you will have to repurchase them. Just like if you miss placed your purse. You have to buy another one.

A--- HECK NO!! Kent Kerschner Photography aka Foto Cowboy, DOES NOT discriminate on the basis of race, religion, national origin, color, sex, age, gender, veteran status, or
disability. It is my intention that all are to be treated equal. I am a photographer for any and all and has been for over 39 years!
